In a general partnership, income and losses flow through to the individual partners which helps them avoid double taxation. Limited partnerships and limited liability partnerships provide liability protection for some partners while still allowing favorable tax treatment. Limited Liability Company (LLC) An LLC gives investors the liability protection of a corporation and the flow through taxation of a partnership. Members therefore get to enjoy limited liability, and income or losses pass through to individual tax returns. This makes LLCs a tax-efficient choice for real estate ownership and therefore is a widely used option. Investors can choose to be taxed in a few different ways. They can either be taxed as a disregarded entity (for single-member LLCs), a partnership, an S or C corporation, depending on their specific tax strategy. S Corporation An S corporation is not a stand-alone entity like an LLC or corporation and is often chosen for its pass through taxation benefits. Profits and losses pass through to shareholders’ personal tax returns and therefore avoid corporate-level taxation. S corporations do however have strict eligibility criteria. Things such as a limit on the number and type of shareholders, as well as the fact that all shareholders must be US citizens or residents that are used to determine eligibility. C Corporation These are not as common for real estate investments but they may be suitable in certain situations. These kinds of corporations are subject to double taxation as profits are taxed at both the corporate level and again when distributed to shareholders. The benefit being that they offer lower corporate tax rates and may be advantageous for investors who are holding properties for the long term.  Real Estate Investment Trust  A Real Estate Investment Trust  is an ownership structure that has been specifically designed for real estate investment. These allow investors to pool funds to invest in a diversified portfolio of real estate assets. At least 90% of taxable income must be distributed to shareholders. Investors therefore receive dividends, and the Trust itself avoids corporate-level taxation. Tenancy in common In this kind of structure, more than one investor co-owns a property and each one has a fractional interest. This provides investors with a tax-efficient way to pool resources and share ownership and doesn’t have the formalities of a partnership. Each investor will report their share of both income and expenses on their individual tax returns which allows for personalized tax planning. Family LLC or Limited partnership These types of structures are often used for estate planning and wealth transfer. They allow for the transfer of real estate assets to family members while maintaining control. The senior generation can therefore retain management control while at the same time giving limited partnership interests to their heirs. Selecting the right ownership structure is therefore a critical decision with significant tax implications. The latest research from eXp UK, the platform for personal estate agents, has revealed which famous TV faces would struggle to make it in today’s property market when taking into account both the pay they take home and the cost of homeownership in their respective areas. eXp UK looked at 12 much loved TV characters, what their onscreen professions would earn today and just how much it costs to purchase a property in their hometowns, before working out the income to house price ratio for each character.  With the current average UK house price sitting at £291,385 and the average gross salary coming in at £25,404, the average income to house price ratio currently stands at 8.2*.  Ian Beale priced out of Albert Square But spare a thought for Ian Beale, long-serving Eastender, who is facing a far less affordable outlook when it comes to the property market. While he may have held many jobs over the years, his fish and chip shop and vegetable stall have seen him through thick and thin. While the average caterer makes £27,886 across the UK, the average cost of a property in the East End of London is a lofty £512,825. As a result, Ian Beale would have a very tough time climbing the property ladder in today’s market with the income to house price ratio coming in at a huge 18.4 – 10.2 higher than the national benchmark. Vicar of Dibley would be Dibley-less Geraldine Granger, otherwise known as the Vicar of Dibley, wouldn’t fare much better. The average earnings for a member of clergy is currently £26,300. The fictional village of Dibley is set in Oxfordshire, where house prices average £445,210, meaning Geraldine would require 16.9 times her income to cover the cost of a home.  Sherlock Holmes has no chance in Westminster While the average detective may earn as much as £62,343 per year, the average price of a home in Westminster is currently £967,277, meaning Sherlock Holmes would require 15.5 times his annual earnings to purchase within the borough today.  Gavin and Stacey would have to make do without Smithy Smithy from Gavin and Stacey would earn £28,109 as a builder and decorator today, but should he want to purchase in his hometown of Billericay, he’d need 13.2 times his annual income to cover the cost of the average property there.  Other famous TV faces priced out of the market Edina Moon from Ab Fab would also need 13 times her annual income as a PR executive to purchase in Holland Park, Alfie Wickers from Bad Education would have to earn 10.9 times his annual earnings as a secondary school teacher to cover the cost of a property in his hometown, while the average price of a property in Postman Pat’s hometown sits at 10.9 times the average earnings of a postman.  Who would make it onto the property ladder? Of the famous faces analysed by eXp UK there are a few who would have less of a struggle than the rest when it comes to the task of achieving homeownership. With a general office manager pulling in £42,156 a year and the average house price in Slough sitting at £312,777, David Brent is facing one of the more affordable house price to income ratios at 7.4.  Alan Partridge would require 5.8 times the average income of a broadcaster to purchase in Norwich, while the average house price in Cornwall is just 4.7 times Doc Martin’s annual income as a GP.  Head of eXp UK, Adam Day, commented: “These famous TV faces are, of course, fictional. However, it’s interesting to see just how many would struggle in today’s housing market based on the locations they live in, the income they generate and the average cost of a home.  Had Ian Beale known just how much house prices in the east end would climb in recent years, he probably would have sacked off the chip shop and invested in bricks and mortar a long time ago. Two-thirds (60%) of people make up their minds about whether they want to buy a house within one minute of seeing the garden.  Planters, trees, driveways, front doors and bin storage all play a key role in the decision making, according to new data.  The survey of 2,001 people carried out by Marshalls, found that 68% of people would be put off wanting to buy or live in a property if there were big design flaws with the front garden that they didn’t like. Looking at the features that appeal to prospective buyers, those supporting biodiversity top the bill. Planters, hanging baskets and real grass areas (21%), as well as trees (20%), wildlife gardens (17%), raised bedding areas (15%) and bird baths (14%) were the top responses, followed by new driveways (14%), bin storage (13%) and privacy screening (12%).  More than two-fifths (43%) said they care more about the appearance of the front of their home now – including their garden, driveway and features like the front door – than two years ago. People’s top reasons for caring about their home’s kerb appeal include improving its appearance from the outside (44%) and improving its value (29%). One in ten want to keep up with their neighbours, while others take inspiration from family and friends (20%), social media (15%) and magazines and TV shows (15%) on how to style the outside of their homes.  In terms of wider housing developments, two-fifths of the research respondents said they’d be more likely to buy a newbuild home if it had well-landscaped communal areas. Safety was also critical, with lighting and CCTV making up the rest of the top three features sought after in shared spaces.  Speaking about the findings, which are outlined in the Marshalls Improving the Landscape white paper, Ben Warren, Managing Director of Landscape Products at Marshalls, said: “In a world where image is so important, it’s no surprise to find that kerb appeal has a huge impact on whether someone buys a property – and these findings prove just how influential is, with the outside of a home impacting a buyer’s decision within a matter of seconds.  “In recent years, we’ve seen a rise in social media trends focusing on the front of homes, with searches for ‘front garden’ on Pinterest increasing 35%. GBCA Report Pushes for Local Government Support of Sustainable Building Practices

The sustainability battle lines have been drawn – a new report has been released by the Green Building Council of Australia, a leading authority on sustainable buildings and communities in conjunction with property industry champion, the Property Council of Australia, calling for more support at a local government level for the adoption of sustainable building practices. A little-known fact about the energy market is that buildings play a significant role in energy use. Data from the report cites that approximately half of Australia’s electricity use, and a quarter of its emissions, and generated by buildings. As the nation works towards evolving emissions targets, how can the private sector work with government stakeholders to forge a brave new world in construction, from the smallest of homes to those built by Australian cranes? The answer, it appears, seems to lie in the role that local government has as a stakeholder and key approver for development, whether it be residential, commercial, or industrial. Several findings on the current state of government leadership on sustainability find a range of inconsistencies around land use, poor sustainability targets, poor procurement policy, and a lack of targeted support. The GBCA report highlights that while sustainability and the built environment typically have strong regulatory representation at a state and federal level, at a local government level, that representation can be wholly inconsistent, even between neighbouring councils. This can cause problems for developers when looking to develop sustainable projects, as they suddenly must contend with a third level of regulation that may not be wholly consistent with the standards they may have previously dealt with in construction. Specifically, the report recommends streamlining planning tools across councils, working collaboratively across legislative borders, as well as with industry and the community to work towards a positive and sustainable outcome. Secondly, the report highlights that a key consideration should be the work that is done on existing and developing council infrastructure, in that it must be sustainable and work towards promoting the high energy efficiency standards that are demanded of new residential and commercial development. In particular, the sustainability leadership of the Wollongong City Council’s work on their Administrative Building – first achieving an Australian Excellence award by the Green Building Council of Australia in 2015, then working towards receiving a further World Leadership award in the years since, as they continued to reduce the amount of energy consumed and water wasted on property. The report highlights the importance of having highly performant government buildings and the range of benefits that they can bring to stakeholders in the community. Thirdly, the report highlights that poor procurement policies can often hamper efforts to work towards sustainable outcomes. It specifically notes that to be successful, national guidelines should be developed to enhance the capabilities of local government to accurately assess value-for-money and sustainability features vs the whole-of-life cost of an asset – a level of detail that local government is unable to consistently apply.  Launching alongside the report was the City of Melbourne’s Retrofit Melbourne plan – a plan for the City of Melbourne to work towards driving down the 66 percent of emissions that come from buildings in the council area. In a city where major manufacturing was discontinued in the last half century, council officials are exploring new and innovative ways to improve the sustainability of the properties in their council areas, without having to demolish and rebuild swathes of apartment buildings. Highlighting the importance of working together with industry, government, and other partners, Deputy Lord Mayor, Nicholas Reece said “It’s crucial we act now – working alongside industry, government and academic partners to future-proof our city for generations to come. We need to get the balance right – protecting our older buildings which give Melbourne its character, while accelerating our collective journey towards zero net emissions.” Another theme highlighted in the report was that there was a lack of mandatory reporting for buildings, concerning sustainability practices. For those who are looking to purchase or rent a property, it’s very unlikely that prospective occupants would be able to find anything publicly listed about the sustainability features of a property – even though it is well-documented that consumers are willing to spend more if they know a property has sustainability features such as high energy efficiency. The importance of connection, and industry partnership, was highlighted as a critical theme throughout the report. Noting that little is done in isolation, the benefits of partnership and working together were highlighted in great detail, at both a domestic and international level. Much can be learned from the overseas experience – all nations are feeling the dangerous impacts of climate change, from Texas’ record-breaking freeze to the European heatwave recently named Cerberus, after the hound of Hades from Greek mythology. A sign of things to come, perhaps? While many nations are experiencing the impacts of climate change, many cities are adopting models that highlight the benefits of adopting the recommendations presented in the report by GBCA. Cities such as Chicago are working to streamline the permit approval process for sustainable buildings, and nations such as the UK are employing policies such as the UK Better Buildings partnership, collaborating with leading commercial property landlords to drive improvements in the sustainability of existing commercial stock. The challenges of climate change may seem insurmountable at times, but the work that cities and nations across the globe are doing to drive down emissions and work towards saving the world is certainly a cause for celebration. What now for the report, now that it has been released? It is hoped that the Albanese government may be able to implement some of the policies at a federal level, such as the sustainability ratings system. Nationwide effort to catch drink and drug drivers gets underway.

Today (1st December 2023) sees the launch of Operation Limit – a nationwide crackdown on drink and drug driving which will see all 43 UK police forces step up efforts to catch motorists who disregard the law. The 4-week long campaign is being coordinated by the National Police Chiefs’ Council (NPCC) and National Roads Policing Operations and Intelligence (NRPOII). Results from every police force will be analysed and ranked – last year, the same campaign saw an 18% rise in arrests with 6,130 drivers caught compared with 5,186 during the same period in 2021. The initiatives ‘National Campaign Status’ will help to mobilise national mainstream media and local television and radio to help to create a greater deterrent, to save lives and serious injuries on our roads. In July this year, drug driving made the headlines when latest government statistics were published showing that drug driving convictions have trebled in five years with a record high of 77 prosecutions a day on average. Owing to the success of these nationally coordinated efforts, NPCC and NRPOII have indicated their intentions to plan and manage an annual Summer Drink Drug Drive Campaign starting in 2024. Previously, efforts throughout the year have largely been confined to police forces with a strong focus on roads policing. National coordination will ensure that every force in the UK will be doing more to catch drink and drug drivers going forward. Ean Lewin, Managing Director of D.tec International, the UK’s sole distributor of DrugWipe, the global leader for police roadside driver drug screening, used by all 43 police forces in England, Wales and Scotland as well as hundreds of corporate clients said; “Drink and drug driving remains the biggest strategic threat to roads policing, and I am delighted to see that NPCC and NRPOII are extending their support for Operation Limit beyond the festive period. Some police forces have started to increase their focus on drink and drug driving even before Operation Limit officially gets underway. Merseyside Police caught 25 drink and drug drivers within the first 24-hours of their campaign. According to their official X (formally Twitter) account, the force has made 172 arrests in 7-days, 47 for drink drive and 125 for drug drive.
