ALEP calls on Government to amend Building Safety Act

The Association of Leasehold Enfranchisement Professionals (ALEP) has written to the Government to call for an urgent amendment to the Building Safety Act 2022 (‘BSA’), which it says is currently causing doubt and uncertainty for leaseholders and the professionals trying to advise them.  ALEP’s letter to Rachel Maclean, Minister of State (Housing and Planning) highlights a key concern over the definition of a ‘qualifying lease’ under Section 119 of the Building Safety Act, which states that the lease needs to have been granted before 14 February 2022 in order to qualify.     Mark Chick, Director at ALEP, said: “As worded, the definition raises the question of whether a new lease granted on or after 14 February 2022 will be a ‘qualifying lease’, in circumstances where the existing lease is a ‘qualifying lease’.   “This issue is causing doubt and uncertainty for leaseholders, which advisors are now obliged to address in each individual case. The issue was compounded by unclear guidance on the matter published by the Department for Levelling-Up, Housing and Communities.   “ALEP contacted the Minister to clarify the definition with the aim of getting clarity for our members and their clients and, subsequently the guidance note has been further amended. Government clearly acknowledges that there is a problem here as the renewed guidance states:  ‘9. If you are a qualifying leaseholder and you extend or vary your lease, you may surrender your existing lease and be granted a new lease. As the new lease will not have been granted before 14 February 2022, the statutory leaseholder protections in the Building Safety Act 2022 will not apply. We are looking to legislate to resolve this issue as soon as Parliamentary time allows. In the meantime, before seeking a new extended or varied lease, leaseholders should seek legal advice and seek to come to agreements with landlords to apply the same protections as contractual terms.’  “Though this revision to the guidance note is helpful, it simply acknowledges that there is now a significant lacuna for anyone with a qualifying lease with BSA protection who wants to extend this. Whilst most leases in affected properties will be ‘long’ leaseholders they may also face issues with ground rents / RPI reviews that they would normally wish to address by a statutory renewal of the lease. The current situation means that this cannot be done without losing the qualifying leaseholder protection.”   “As the updated guidance note acknowledges, the Government now needs to address the deficiencies in the current wording of the Building Safety Act legislation to clarify the definition of a ‘qualifying lease’.”   He continues:  “Whilst the policy objective and overarching goal for leasehold reform has been to make the process ‘simpler, quicker and cheaper for leaseholders,’ the definition of ‘qualifying lease’ contained in Section 119 of the BSA fails on all three counts.  “It has not made the process simpler because the issue of whether the new lease is protected under the Act has been made far more complex. It has not made the process quicker, because the uncertainty caused gives rise to a whole area of specialist enquiry to be undertaken before a claim can be made.   “And it has not made the process cheaper, both because it raises the question of whether the removal of protected status gives rise to any valuation issues, and because the extra work involved necessarily incurs additional professional fees.   “I cannot believe that it was the Government’s intention to create doubt and uncertainty. However, if the goal is to ensure that a new lease granted under the 1993 Act can be a ‘qualifying lease’, then the absence of any express provision to that effect in the Building Safety Act is surprising and confusing.  “The Government urgently needs to resolve this problem, and as they now acknowledge a simple amendment to the legislation is required to make it clear that statutory and other renewals of leases will not lose qualifying leaseholder protection. RED Construction London, a regional arm of RED Construction Group that operates in across London and the south east, has announced its appointment to deliver phase one of The Sheppard Trust’s redevelopment of the Royal Cambridge Home in Surrey. As part of the £8m first phase, RED Construction London will carry out works to demolish around two thirds of the existing buildings, replacing the section with a state-of-the-art 32-bed care home. The new building will be fully wheelchair accessible and will provide residential long term and respite care. Specialist architects, PRP, have carefully designed the new care home to respect the street scene and conservation area, by creating elegant buildings which are reflective of the villas that currently occupy the site. Each of the 32 bedrooms will be fitted with ensuite bathrooms, and the new home will provide high quality communal facilities including a lounge overlooking the gardens as well as a hair and beauty treatment room and a full catering kitchen. Located in East Molesey and operating as a not-for-profit facility, the redevelopment will optimise the site’s ability to provide high quality facilities for the elderly, so that the Royal Cambridge Home can continue to offer first class care in a building designed to meet modern requirements. A new centre for green hydrogen innovation and product development has been launched by Heriot-Watt University in collaboration with hydrogen technologies experts Logan Energy and PlusZero. The newly named ‘Hydrogen Works’ building will see the consortium collaborate across a range of hydrogen-related research and industry projects including clean-power generators, state-of-the-art refuelling infrastructure and cutting-edge energy systems for heavy industry. As part of Heriot-Watt University’s pioneering strategy to engage with business and become leaders in sustainability, it is reshaping its Riccarton Campus in Edinburgh to house innovative companies and clusters, including Logan Energy and PlusZero. The Scottish Government recently published a draft Energy Strategy and Just Transition Plan setting out its plans to kickstart the production of low carbon hydrogen and carbon capture and storage as part of its ambition to decrease industrial emissions by 43% by 2032. It’s estimated that Scotland’s energy-intensive industry, which relies on polluting fossil fuels, is responsible for up to 15% of the nation’s greenhouse gas emissions. Professor Gillian Murray, deputy principal for business and enterprise at Heriot-Watt University, said: “Working hand-in-hand with business is at the very heart of what we do at Heriot-Watt University. Train to Gain – future-proofing the construction industry

Investment in infrastructure is a key growth priority for many European governments, but how can this be reconciled with the current skills crisis facing the construction sector? According to the latest EURES report on labour shortages and surpluses, 38 per cent of European countries who ranked building construction labourer shortages noted the issue as ‘high magnitude’[1]. A combination of macroeconomic influences ranging from an aging workforce preparing to retire, to labour market shifts caused by Brexit and war in Ukraine are all having an impact on skilled worker availability in Europe. This is further complicated by retraining needs caused by continuous advancements in sector technology, tools and products which begs the question – how can we better future-proof the construction workforce? Skills and competence are critical for the future of the construction industry, and various factors have accelerated the sector’s skills shortage to a crisis point. There is no silver bullet when it comes to tackling the skills crisis within the construction industry, particularly given the number of external forces at play. However, if we want to meet growing construction demand then we must grow the available workforce to make this a reality – creating an imperative for companies to incentivize and invest in diversifying the skillset of their current workforce rather than relying solely on technology. Through Victaulic’s work and customer engagement, we have identified and responded to the need for more specialised and accredited training programs in both a hands-on and virtual format to facilitate greater upskilling. Whilst seemingly obvious, such programs have been scarce since the Covid-19 pandemic with existing staff unable to refine their skills with new technologies and entrants losing out on the opportunity to formally learn the basics with new tools and products. By bridging the training gap, construction professionals across all sectors and experience-levels can gain greater confidence in their proficiency, whilst companies receive the critical assurances that their projects are up to code. This is particularly the case for the fire protection industry. As an industry which is constantly evolving and premised on the delivery of safe and efficient fire protection systems, it is crucial that training is both readily available and regularly updated to ensure that engineers and contractors have the requisite knowledge for their reliable installation and comply with regulations. At a broader scale, investing in training is also crucial for a company’s reputation building. Comprehensive training ensures industry professionals are getting the most from every application, whilst upholding and protecting standards. Victaulic’s increase in customer demand for training is a testament to this, with a recent in-person fire protection workshop attracting nearly 100 participants. With an age range of between 17-65+ and job titles spanning construction managers, design managers and subcontractors – there is a clear desire from customers and their employees to upskill and refresh their knowledge through in-person training. The workshop with construction engineering company, Mercury, provided an introduction to Victaulic fire protection products such as the VicFlexTM Flexible Sprinkler Fittings series and FirelockTM couplings, their applications in fire protection systems, and requirements for maintenance in accordance with applicable codes and standards. The value of this in-person training at their facility in Ireland could not be overstated, with Mercury implementing the bespoke demo rig at their facility to enable regular refreshers for their employees. The training did not stop there, with additional e-learning services provided through our Victaulic University platform. What was historically a portal used exclusively by our internal teams, Victaulic University training has become a mainstay for e-learning for our clients. One of the key benefits of our e-learning training is that is offers a range of options to suit different levels of expertise. For instance, beginner-level fire protection training covers the basics of fire protection system design and installation, whilst advance courses delve into the details of system testing and maintenance. Additionally, participants can work through the training programs at their own pace, providing the flexibility to manage their workloads while still acquiring essential skills. For the Mercury training alone, we saw 80 participants join online for 20 hours’ worth of training prior to the hands on workshop. With every worker who completes our training receiving a certification, our courses not only support with our customer’s credibility within the fire protection industry but also grant assurance that they have been equipped with the knowledge to properly install our products. This was why we were so appreciative of the practical in-person Fire Protection Customer Training provided by Victaulic – giving us an opportunity to see first-hand how the Victaulic valve-sets work and refresh our skills with the on-site demo rig.” “The Victaulic experts provided our 80+ team with comprehensive product knowledge and technical detail which will help us better deliver fire protection systems for our clients.” Whilst upskilling cannot entirely remedy the skills crisis that Europe is currently facing, what is clear is that there are simple, cost effective means to attract and retain a greater body of talent already at our fingertips. Training is only one piece of the puzzle, but the reputational benefits offered at a company level along with the empowerment derived at an employee level are vital steppingstones to future-proofing the construction industry. Female site worker in Dorset addresses three myths for women working in construction in latest video

A female assistant site manager from Dorset has addressed three myths associated with working in construction as a way of encouraging more women into the industry. Victoria Grinnall, 27, works at Barratt Homes’ Quarter Jack Park development in Wimborne. Before joining the leading housebuilder in 2021, she came up against many misconceptions about working in the industry, which she hopes to dispel so that women can see how attractive a career in construction can be. As someone who formerly served in the armed forces as a Royal Engineer, being the first female to drive armoured vehicles before going on to work for a youth engagement programme for schools about careers in the army, Victoria is passionate about encouraging the next generation of construction workers. In her latest video about Women in Construction, Victoria talks to Barratt Homes about what it’s like working in the industry and covers these three myths: Myth 1 – construction is still dominated and run by men “Some roles are still dominated by men, but that’s because there still aren’t enough females – yet,” says Victoria. “My experience of working in construction is feeling supported, valued, and trusted. At Barratt, we have yearly subcontractor meetings, where teams are told by directors in the business how to treat and respect others, as part of the Diversity and Inclusion programme. “Women can bring so much to the role, and I’d encourage them to do as much research as they can if construction is an industry they are interested in. It’s nice to see that Barratt want to bring more women into the business – and it shows.”  Myth 2 – there’s a massive stigma around women working in construction “I don’t think there is enough of us just yet to say there isn’t a stigma, but it isn’t as big as it used to be – and I certainly rarely come across it,” Victoria continues. “If anything, I find people to be open minded and curious. They enjoy learning more about what I do – and I am happy to tell them all about the role I love! “There are so many avenues for women in the construction industry and there is a huge variety of career choices, whether that is office-based or site-based. Barratt will help women wanting to get into the industry and you’ll have a really supportive team around you – so I hope one day that stigma wont exist.” Myth 3 – my family won’t approve of my career choice “I think my family knew better than I did that this was the right career path for me!” Victoria said. “I like being outside, I’ve always liked being active, and I have never been someone to sit behind a desk. They often tell me this is what I was made to do! “For those who are worried about how a role in construction may be perceived by friends and family, you might be surprised that their reaction isn’t what you think it’ll be.” Barratt Homes’ Diversity and Inclusion programme officially recognises and celebrates differences across the whole organisation. Beard delivers major refurbishment and rebuild at Surrey school

Beard Construction’s Guildford office has delivered a key £6.3m refurbishment and rebuild project at St Andrew’s Catholic secondary school in Leatherhead. Started in March 2022 and handed over April, the work saw the comprehensive conversion of existing classrooms into science labs, ICT rooms, a drama studio and design and tech classrooms, the construction of a two-storey extension to create new classrooms and offices and the construction of a new two-storey building to house food technology, ICT, business studies work rooms and a new drama studio. Phases one and two of the work at the 1500 pupil school were carried out to a tight deadline during the summer holidays and saw existing 1950s classrooms stripped back and converted to a suite of state-of-the-art and pupil-ready science laboratories, ICT classrooms, music and drama studio. The finished labs included gas infrastructure and mobile fume-cupboards, while the new drama studio incorporated a new system of lighting rigs and speakers. Phase three saw a standalone classroom block converted to provide new construction, design and technology teaching spaces. For phase four, a new-build extension added two 400m2 floors consisting of nine new English and History classrooms, two offices and two new sets of toilets to the school’s existing Earl Building. Finished in black and gold brickwork, the classrooms are flooded with light by new five-metre windows. Finally, phase five of the project saw the demolition of the school’s Woodlands Building and the construction of a new two-storey block, faced with Bath stone blocks and zinc cladding – which continues upwards to form a zinc roof. The ground floor of this new 1000m2 building houses two huge food technology teaching and preparations areas, alongside a massive drama studio with a 6m-high ceiling including lighting and speaker rigs. Upstairs, the building provides four fully fitted ICT/business studies teaching rooms.  The building also includes office spaces and two sets of toilets. All the new and refurbished classrooms include interactive whiteboards. Apart from the initial refurbishment, all of the work has been carried out while pupils used the rest of the school. Beard traffic marshalls and banksmen ensured the safe delivery of materials across a specially constructed track-matting road on the school playing field. Beard Guildford director Pat Hughes said: “Beard has special expertise in the education sector and we are more than aware of the importance of creating spaces which both inspire pupils to learn as well as being great places for teachers to work. This project has transformed the learning experience for the pupils and staff at St Andrew’s School.” St Andrew’s headteacher Alan Mitchell said: “The ambition at St Andrew’s is simple – to be the best school in the country. We set the highest goals and expectations for every pupil and these new classrooms and teaching facilities provide the infrastructure to help us deliver on that ethos. “Not only has the Beard team delivered a quality product on time, but it has done so with no disruption to the school’s day-to-day operation. ” Beard worked in close collaboration throughout the project with architect Hamson Barron Smith. Modular construction specialist Rollalong has recruited another experienced director to further strengthen its senior team. Keith Woodlock has been appointed as Project Director responsible for main contracts and major works, with a focus on the defence sector and MOD contracts. Keith has many years’ experience in both modular and traditional builds and has worked on major projects including the Wave Hotel at Butlins Bognor Regis, 5 Churchill Place in Canary Wharf, and Orchard Plaza in Poole. He has worked in main contracting for large PLCs helping to deliver landmark buildings, offsite solutions and refurbishment schemes nationwide.
